Paternity can be determined before birth through prenatal testing, which can be done during the 10th through the 24th week of gestation using amniocentesis or chorionic villi samples collected by an OB-GYN. The mother’s participation is required.

Chain-of-Custody Requirements
Chain-of-custody requirements must be fulfilled for test results to be defensible in any legal situation, such as inheritance disputes. These requirements include the following:
- Samples are collected by a neutral third party, such as an OB-GYN (for prenatal samples), clinic, or laboratory
- The individuals tested are positively identified (i.e., they present a government-issued ID to be photocopied and/or they are photographed and fingerprinted)
- A Prenatal kit is used for the collection of the prenatal sample; this kit includes a Prenatal Client Identification and Consent Form for the mother and OB-GYN to sign
- If a prenatal sample was previously collected and is stored at a laboratory, the laboratory must complete the Prenatal Specimen Identification Form and the mother must complete the Specimen Testing Authorization Form
- The mother and alleged father(s) complete and sign the Client Identification and Consent Form
Non-Chain-of-Custody Requirements
In a non-chain of custody test, the buccal swab samples are collected by the patients themselves. Prenatal samples may be collected by the mother’s OB-GYN, and we also accept samples submitted by a laboratory. Results of this test are for personal knowledge only and may not be used for legal purposes.
- An in-home kit is used, and buccal samples can be collected by the patients themselves at a time and place of their choosing
- Since the origin of the samples cannot be verified, names are listed on the report in the same way they are labeled on the samples
- A unique barcode is assigned to each kit appears on the report as a reference for the case
- Barcoded kits are assigned to your account for easy reference
Notes
- CVS (chorionic villi sampling) is usually performed during the 10th–13th week of gestation. This is done either transcervically (through the vagina) or transabdominally (using a long needle through the abdomen). The laboratory needs 5 ml with 2-3 good branches
- Amnio (amniocentesis) is usually performed during the 14th–24th week of gestation. The procedure involves drawing amniotic fluid (5ml) from the sac surrounding and protecting the fetus. This fluid contains some viable (live) cells that have been shed by the fetus
- Because both Amnio and CVS are invasive, the patient should speak with a physician about the risks involved in this type of prenatal testing
- Our fees do not include the OB-GYN fee for collecting the prenatal sample. This fee can range between $500 to over $2,000.
